IP and Counterfeit Reporting Policy

Purpose
TCBinder is a marketplace where individual sellers list trading cards from their own collections. We take counterfeit goods and intellectual property infringement seriously, and we remove listings that violate this policy.
You do not need a TCBinder account to file a report. This process is open to rights holders, their authorized agents, grading companies, law enforcement, and members of the public.
What Is Not Allowed
Sellers may not list, and we will remove:
- Counterfeit, fake, or unauthorized reprint cards
- Cards that have been trimmed, recolored, resurfaced, or otherwise altered without disclosure
- Cards in counterfeit grading holders, with forged or reused certification labels, or with a misrepresented grade or grading company
- Stolen cards, or cards the seller does not own or have the right to sell
- Listings that infringe a trademark or copyright, including unauthorized use of a brand name, logo, player likeness, or product imagery
- Custom or fan-made cards presented as officially licensed product
How to Submit a Report
Email legal@tcbinder.com with the subject line "IP / Counterfeit Report" and include all of the following. Incomplete reports slow us down, and we may need to come back to you before we can act.
- Your full name, company, and job title
- Your relationship to the intellectual property — whether you are the rights holder or an authorized agent acting on their behalf
- Contact details: email address, phone number, and mailing address
- Identification of the intellectual property at issue — the trademark, copyright, or other right, and its registration number if it has one
- Identification of the specific listing or listings, by URL, card title, order number, or seller username. Please be as specific as possible — we cannot act on a report that only names a category or a brand generally
- An explanation of why the listing is infringing or counterfeit, including any evidence you have
- A statement that you have a good faith belief that the use is not authorized by the rights holder, its agent, or the law
- A statement that the information in your report is accurate, and that you are authorized to act on behalf of the rights holder
- Your physical or electronic signature
What Happens Next
- Acknowledgement within 2 business days. We confirm we have received your report and tell you if anything is missing
- Review and action within 10 business days. We investigate the listing and the seller's history
- Where a report is substantiated, we remove or disable the listing, notify the seller, and take account action where warranted, up to suspension or permanent ban
- Where a sale has already completed, we retain the full transaction record and will provide it in response to a lawful request, and the buyer may pursue a claim through PayPal Purchase Protection
- If a report needs longer — for example because we need to verify a certification number with a grading company or obtain further evidence — we will tell you that and keep you updated, rather than leave your report open without explanation
- We will tell you the outcome of your report
If Your Listing Was Removed
If you are a seller and believe your listing was removed in error, reply to the notice we sent you, or email legal@tcbinder.com with evidence supporting the card's authenticity — for example a grading certification number that can be verified with the grading company, purchase records, or provenance. We will review it and reinstate the listing if the report was mistaken.
Repeat Infringers
We keep a record of substantiated reports against each seller. Sellers with repeated substantiated reports have their marketplace access removed and their accounts terminated. A single sufficiently serious violation — such as knowingly selling counterfeit cards or cards in forged grading holders — may result in immediate permanent removal.
Misuse of This Process
Knowingly filing a false or bad faith report — for example to remove a competitor's listing — is a violation of our Terms of Service, and may carry legal liability. We may decline to act on reports from a source that has repeatedly submitted unfounded claims.
Reporting From Inside the App
If you have a TCBinder account, you can also report a listing, an order, or a user directly in the app. Those reports go to the same review queue. The email route above exists so that rights holders and anyone else without an account can reach us just as easily.
