Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and TC Binder ("we," "our," or "us") governing your access to and use of our trading card collection management platform. By creating an account, accessing, or using our service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our service.

Eligibility

You must be at least 13 years old to use TC Binder. If you are under 18, you must have permission from a parent or legal guardian. Buying and selling in our marketplace additionally requires you to be at least 18 years old (see Marketplace: Buying and Selling below). By using our service, you represent and warrant that you meet these eligibility requirements.

User Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your password
• Notify us immediately of any unauthorized access or security breach
• Accept responsibility for all activities that occur under your account
• Not share your account credentials with others
• Not create multiple accounts or impersonate others

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

License and Restrictions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our service for your own personal or business use in managing, tracking, and selling your trading card inventory. You agree NOT to:

• Copy, modify, distribute, sell, or lease any part of our service
• Reverse engineer, decompile, or attempt to extract source code
• Remove, alter, or obscure any proprietary notices
• Use automated systems (bots, scrapers) to access the service
• Interfere with or disrupt the service or servers
• Attempt to gain unauthorized access to any systems or data
• Use the service for any illegal or unauthorized purpose
• Violate any applicable laws or regulations

User Content

You retain all ownership rights to content you upload to TC Binder ("User Content"), including card images, descriptions, and other data. By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, and distribute your User Content solely to provide and improve our service.

You represent and warrant that:

• You own or have the necessary rights to upload and share your User Content
• Your User Content does not infringe on any third-party rights (copyright, trademark, privacy, etc.)
• Your User Content does not contain illegal, harmful, or offensive material
• You will not upload malware, viruses, or malicious code

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, at our sole discretion.

Prohibited Conduct

You agree not to:

• Harass, threaten, or harm other users
• Impersonate any person or entity
• Post spam, advertisements, or unsolicited messages
• Engage in fraudulent activities or scams
• Collect or harvest user data without permission
• Interfere with other users' enjoyment of the service
• Violate any applicable laws, including copyright and trademark laws
• Use the service to distribute counterfeit or stolen goods

Marketplace: Buying and Selling

TC Binder operates a marketplace where users list cards from their own inventory and sell them to other users. This section governs those transactions.

Who Can Buy and Sell

You must be at least 18 years old to buy or sell in the marketplace. Marketplace payments are processed through PayPal, which requires account holders to be 18 or older, and a marketplace sale is a binding contract between buyer and seller. Users aged 13 to 17 may still use TC Binder's inventory, collection, pricing, and social features, but may not list cards for sale, make offers, or complete purchases.

Our Role

The seller is the seller of record. When you buy a card on TC Binder, you are buying it from the individual seller who listed it, not from TC Binder. The seller owns the card, sets the price, decides whether to accept your offer, and is responsible for packing and shipping it to you.

TC Binder provides the venue, the listing tools, and the payment and shipping integrations. We do not buy, own, hold, warehouse, or resell inventory, we are not a party to the sale contract between buyer and seller, and we never take custody of a seller's sale proceeds. Payment is processed by PayPal and settles directly to the seller.

Fees

• Processing fee: a 5% fee is added to the card price and paid by the buyer. It is shown to you as a separate line item before you submit an offer and again at checkout, so the total you will pay is always disclosed in advance
• Sellers pay us no commission on a marketplace sale. The 5% is added on top and paid by the buyer; we do not deduct anything from the seller's proceeds
• PayPal's own fees apply to the seller on the amount they receive, under their agreement with PayPal, not with us
• Shipping labels purchased through TC Binder are paid for by the seller at carrier cost plus the card processing fee charged by our payment processor

Taxes

You are responsible for determining, reporting, and paying any taxes arising from your activity on TC Binder, including income tax on your sales. We do not provide tax advice. Depending on your sales volume and where you live, our payment processor may be required to report your earnings to tax authorities and issue you a tax form. That reporting is between you and them. If you are selling as a business, you are responsible for any sales tax obligations that apply to you, except that in states where marketplace facilitator laws require us to collect and remit sales tax on your behalf, we will do so and may add a tax line to your buyer's checkout total; that does not change your own tax reporting responsibilities anywhere else.

Seller Obligations

If you list a card for sale, you agree to:

• Own the card and have the right to sell it
• Describe it accurately, including its condition, grade, grading company, and any damage, alteration, or restoration
• Use photographs of the actual card being sold
• Honor an offer once you accept it
• Ship within 3 business days of payment and provide valid tracking through the platform (see Shipping Window below)
• Keep enough in your PayPal balance to cover refunds on your sales
• Not list counterfeit, reprinted, altered, trimmed, or stolen cards, or misrepresent grading
• Not attempt to move a transaction off the platform to avoid fees or buyer protection

Buyer Obligations

• Pay within the payment window shown on your order (currently 24 hours from the moment your offer is accepted). Unpaid orders are automatically cancelled once that window passes, and the card is returned to the seller's available inventory. Each order cancelled for non-payment counts against you: at 3, you can no longer make offers, use Buy It Now, or check out until support reviews your account
• Provide an accurate shipping address
• Not submit offers you do not intend to honor

Sellers may set a minimum offer threshold as a percentage of their asking price, below which offers cannot be submitted. Once an offer is accepted, the card is locked as pending and cannot be sold to another buyer.

Offers

An offer is a commitment to buy the card at that price if the seller accepts it. You can withdraw your own offer within 60 minutes of making it, or at any time after the seller counters. An offer or counter that gets no reply within 48 hours expires. Once an offer is accepted it becomes an order, and the payment window above starts.

Shipping Window

• Sellers should ship within 3 business days of payment. Business days are Monday through Friday, not counting US federal holidays
• An order counts as shipped when the carrier first scans the package. Buying a label or entering a tracking number does not count on its own
• If a paid order has no carrier scan after 5 business days, it counts as a late shipment strike against the seller. If the seller bought a label through TC Binder before then, the strike is held instead: it comes off when the carrier scans the package, and only counts if there is still no scan after 10 business days
• A late order is not cancelled or refunded automatically. The buyer can report a problem on the order (see Returns, Refunds, and Disputes)
• Labels bought through TC Binder for orders of $750 or more include signature confirmation. Sellers shipping those orders another way should add signature confirmation too
• If you replace a tracking number, the original stays on the order record

Cancellations and Seller Strikes

A paid order can be cancelled before it ships, by the seller or by both together when the buyer asks. The buyer always gets a full refund. A cancellation the buyer asked for and agreed to does not count against the seller. Any other seller cancellation is a strike, and so is a late shipment (see above) and a PayPal dispute decided in the buyer's favor. One order never counts as more than one strike. 3 strikes within 90 days triggers a review by TC Binder, and 4 pauses online selling for 14 days. In-person sales through the register are not affected. Contact support if you believe a strike was not your fault.

Returns, Refunds, and Disputes

Because the seller is the seller of record, the sale proceeds go to the seller's PayPal account, and refunds come back out of it. Payments are processed through TC Binder's PayPal platform integration (PayPal Complete Payments), not a direct PayPal Goods & Services payment between buyer and seller, so refunds are issued in the app on the seller's behalf: when the seller cancels or refunds, or when both agree to cancel. If a refund can't be completed because the seller's PayPal balance is too low, the seller must add funds, and we may pause their selling until it is resolved. When an order is refunded in full, our 5% processing fee is refunded too, so the buyer gets back everything they paid. PayPal does not return its own processing fee on a refund: the seller pays back the full sale amount and PayPal keeps the fee it charged on that sale.

TC Binder does not decide refund disputes between buyers and sellers. PayPal does. The one thing we step in on is late shipping: if a paid order is past its ship-by date and hasn't shipped, the buyer can report it on the order page. The seller then has 2 business days to ship it (or refund it). If it still hasn't shipped, the buyer can open a dispute with PayPal under PayPal's Purchase Protection program, and we give the buyer the order details to include. Problems with the card itself or with delivery (damage, condition, a package that never arrives) go straight to PayPal, and reviews show other buyers how a seller packs and ships. PayPal already receives the shipping address and tracking for orders paid through TC Binder, and PayPal's decision on the payment is final as far as TC Binder is concerned. PayPal disputes must be opened within 180 days of payment. If a package is delivered after the buyer was refunded, the buyer must pay for it or return it. In rare cases, such as fraud or a technical error, TC Binder may cancel and refund an order itself.

Payments made outside TC Binder (Venmo, Zelle, Cash App, PayPal Friends & Family, or cash for an online order) are not processed by us and are not covered by anything above. We can't help recover them, and asking for one is against these Terms.

What TC Binder does do: we keep and produce the full record of any order on request (offer amount, acceptance time, messages, shipping address, label, tracking, and the order's change history); track reported problems, late shipments, unpaid orders, and lost disputes on each account; review reports of fraud or misrepresentation; remove listings and pause, suspend, or ban users who violate these Terms; and refund our own 5% processing fee on any order refunded in full. Only sales paid through TC Binder checkout count toward a seller's sales count and reviews.

To report a listing that infringes your intellectual property or that you believe is counterfeit, see our IP and Counterfeit Reporting Policy. You do not need a TC Binder account to submit a report.

Free Trial

New accounts get a 14-day free trial of Dealer plan features: unlimited cards in inventory, unlimited sale recording, the full analytics dashboard, custom profile layout, and barcode labels and CSV export. AI scanning and live comps are unlimited on every plan, including Free, so the trial doesn't change those.

• No payment method required: The trial starts automatically when you sign up. We don't ask for payment information to start it, and nothing is charged automatically when it ends.
• When it ends: Your account reverts to the Free plan. If your active inventory is over the Free plan's card limit at that point, we may pause your oldest cards until you're back under the limit or you upgrade; nothing is deleted.
• Card show offers: Some card show codes give free time on the Dealer plan (for example, a free month) to any account that has never had a paid plan, while the offer is running. That offer needs a payment method, and the plan renews automatically at the regular monthly price when the free time ends unless you cancel before then. If you claim it during your free trial, the free time starts when the trial ends. We email you 3 days before the first charge, and you can cancel anytime in Billing. One per person.
• One trial per person: Each email address gets one free trial. Creating a new account after your trial has ended, including after deleting a prior account, does not grant another trial.

Subscription Plans and Billing

TC Binder offers both free and paid subscription plans. For paid plans:

• Billing: You will be charged in advance on a recurring monthly or annual basis
• Auto-Renewal: Subscriptions automatically renew unless cancelled before the renewal date
• Payment Method: You must provide valid payment information and authorize us to charge it
• Price Changes: We may change subscription prices with 30 days' notice
• Cancellation: You may cancel anytime; cancellation takes effect at the end of the current billing period. Subscriptions billed through TC Binder are cancelled in your account settings; subscriptions purchased through the Apple App Store are cancelled in your Apple ID subscription settings
• App Store Billing: If you subscribe through the Apple App Store or Google Play, that store bills and processes your payment directly, its own terms and refund policies apply to the transaction, and your subscription is managed and cancelled through that store's subscription settings rather than in your TC Binder account
• Refunds: We do not offer refunds for partial months or unused portions of subscriptions

Intellectual Property

The TC Binder service, including its design, features, software, and content (excluding User Content), is owned by us and protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.

Third-Party Services

Our service may contain links to third-party websites or integrate with third-party services (such as social media platforms). We are not responsible for the content, privacy practices, or terms of these third-party services. Your use of third-party services is at your own risk.

Card identification, comp pricing, and sold-listing data (including "Comp Avg," estimated value, and sale history shown throughout the app) are sourced from third-party providers, including Card Hedge and CardSight. This data is provided for reference only and reflects past sale prices reported by those providers; it is not a professional appraisal, a guarantee of what any card will sell for, and not financial or investment advice. We do not independently verify third-party pricing data and are not responsible for its accuracy.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois and the United States, without regard to conflict of law provisions. Any disputes not subject to arbitration shall be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction of such courts.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the service after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the service.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and TC Binder regarding the service and supersede all prior agreements.
